The basis in the Labor Code
Article L6321-1 of the Labor Code requires the employer to ensure employees' adaptation to their job and to maintain their ability to keep a position, particularly regarding technological changes. When AI transforms your role, this adaptation obligation is triggered.
The basis in the AI regulation
Article 4 of Regulation EU 2024/1689 requires providers and deployers of AI systems to ensure a sufficient level of AI literacy among their personnel. Any organization using AI, even purchased, is concerned as a deployer. This obligation has been applicable since February 2, 2025.
What you can request
If your role involves AI, you can legitimately ask for appropriate training. The professional interview, provided for by Article L6315-1 of the Labor Code and distinct from the performance review, is an appropriate time to discuss your upskilling needs.
Limits to know
The adaptation obligation does not mean an unlimited right to any training. It targets your ability to perform your job given changes. The AI literacy obligation calls for a sufficient level, proportionate to the context, without a mandated format.
